LED needs CE
CE-labelling will be mandatory newly for the most types of lamps from September 2013. But why?
CE-labelling confirms that the product in question matches all requirements of all existing and relevant EU-directives and –ordinances at the time of being marketed. And that the product-relevant evaluations regarding the harmony with EU law have been executed.
The legislating base for CE-labelling in Germany is provided by the so called „Produktsicherheitsgesetz“ (ProdSG), which you could translate with ordinance to the Technical plant and equipment act along with the escorting legislation, namely ProdSV.
Since march 2008 companies have to attach the CE label additionally to products which are covered by the Eco-Design-Directive, which is in Germany transformed to law by the so-called „Energiebetriebene-Produkte-Gesetz” = EBPG, or called ErP.
Two ordinances for LED and lamps rely on this Eco-Design Directive.
- EU ordinance 244/2009 for household lamps with unbundled light (enacted 2009 in Germany) and
- EU ordinance 1194/2012 for almost all lamps and LED, which will be executed from September 1st, 2013.
Thus all LED, lamps and luminaires, which are covered by this ordinance, have to be labelled with the CE sign and must been run – successfully - through all relevant evaluation procedures for EU conformity.
Must ElektroStoffVerordnung/RoHS2 have to be cared about?
The ElektroStoffVerordnung performs in Germany the novelized RoHS-ordinance (Richtlinie 2011/65/EU) since May 2013. This ordinance, so called RoHS2, covers almost all electrical and electronic products under its legislative meaning. For some products, for sure, there exist exceptions. The currently enacted exceptions for compact fluorescent lamps containing mercury will remain executed under RoHS2.
In Germany, with ElektroStoffV manufacturer and importers have to carry out more administrative duties and obligations than before (namely among others the conformation of EU harmony plus enwidened technical documentations).
